Terms of Service

Scope
These terms govern the use of Site Services, a hosted form backend operated by Squibble GmbH, Rossbergstrasse 30, 8310 Kemptthal, Switzerland (“Squibble”), by companies and other organisations (“customers”). Site Services is not offered to consumers. Access is currently by invitation. An individual offer or agreement takes precedence over these terms; the customer’s own terms and conditions do not apply.
The service
Site Services receives form submissions from websites operated by or for the customer, validates them against the configured fields and rules, stores them and, where configured, notifies designated recipients by email. Forms reach Site Services through a same-origin proxy on the customer’s website, which the customer operates. The functions available to a customer are those described in its offer. Squibble develops the service further and may change functions as long as the agreed purpose is maintained.
Accounts and access
Users sign in to the Site Services application with the login it provides. The customer keeps login credentials and API keys confidential, gives access only to authorised persons and informs Squibble promptly of any suspected misuse. API keys can be revoked at any time. The customer is responsible for activities carried out under its access.
Acceptable use
The customer must not use Site Services to send spam or unsolicited advertising, to collect personal data unlawfully or without the information required by law, to process unlawful content or content that infringes the rights of others, to probe, overload or circumvent the security measures and rate limits of the service, or to connect websites it is not authorised to operate. If there are concrete indications of such use, Squibble may suspend the affected forms or access and informs the customer where possible.
Customer responsibilities
For the submissions it collects through Site Services, the customer is the controller under data-protection law, and Squibble processes this data on its behalf under the data processing agreement. The customer decides which fields its forms collect, informs visitors in its own privacy notice, obtains any consent required and handles requests from data subjects. It keeps its website, proxy configuration and recipient addresses up to date.
Availability
Squibble operates and monitors Site Services with care but does not guarantee uninterrupted availability or particular response times unless an offer expressly agrees a service level. Maintenance, security measures and events outside Squibble’s control can cause interruptions. Site Services is not an archive: submissions are deleted when the configured retention period ends, and the customer keeps its own records where the law requires them.
Fees
Fees, billing periods and payment terms are set out in the individual offer. Pilot terms during early access are agreed individually.
Liability
Squibble is liable for damage caused intentionally or through gross negligence. To the extent permitted by law, any further liability is excluded, in particular for slight negligence, indirect and consequential damage, lost profit, lost data and the conduct of auxiliary persons. Mandatory statutory liability remains unaffected.
Term and termination
The term and ordinary notice periods follow the individual offer. Either party may terminate for good cause without notice. When the contract ends, Squibble deletes the customer’s data as described in the data processing agreement.
Changes to these terms
Squibble may amend these terms. It informs customers of changes by email at least 30 days before they take effect. If a customer objects within this period, either party may terminate the affected service when the changes take effect; otherwise the changes are deemed accepted.
Governing law and jurisdiction
Swiss law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction is the registered office of Squibble GmbH, subject to mandatory places of jurisdiction.
